Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Grata Health Inc. ("Luna," "we," "us," or "our") concerning your access to and use of our mobile application and services (collectively, the "Services").

By accessing or using Luna, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

Eligibility

You must be at least 18 years of age to use Luna. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Description of Services

Luna is a recovery companion application designed to provide conversational support, daily check-ins, and progress tracking for individuals navigating recovery. Luna uses artificial intelligence to provide personalized responses and remember your conversations over time.

Important: Luna is not a substitute for professional medical advice, diagnosis, or treatment. Luna does not provide emergency services. If you are experiencing a medical emergency, please call 911 or your local emergency services immediately.

User Accounts

To use certain features of Luna, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

Acceptable Use

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Services or servers
• Use automated means to access the Services without our permission
• Impersonate another person or entity
• Transmit viruses, malware, or other harmful code

Intellectual Property

The Services, including all content, features, and functionality, are owned by Grata Health Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.

User Content

You retain ownership of any content you submit to Luna, including your conversations and personal information. By using the Services, you grant us a license to use, store, and process your content solely to provide and improve the Services.

Privacy

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Luna is not a licensed healthcare provider and does not provide medical advice. The information provided through Luna is for informational and support purposes only and should not be relied upon as a substitute for professional medical advice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRATA HEALTH INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL ARISING OUT OF YOUR USE OF THE SERVICES.

Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Services. Your continued use of the Services after such notice constitutes acceptance of the modified Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising from these Terms or your use of the Services shall be resolved in the state or federal courts located in the State of Delaware.
